This is a plea for help and for those with means to bring sunlight to where there is none, from Frank Martin (Bella Bella) and Helen Michell (Carrier) both Indigenous persons and husband and wife I have known and seen up-close over many years.

The tactics and patterns of harassment of Natives and Native activists in both Canada and the U.S. are legend and documented in many venues–or can be and will be. http://jimcraven10.wordpress.com/2012/06/22/legal-case-against-government-of-canada-for-genocide-against-indigenous-peoples/ Because the Reserves and Reservations are often so isolated and with no mass transport to speak of, no medical facilities to handle serious cases, no variety of amenities and stores, Indigenous Peoples are isolated and at the mercy of the national and local law enforcement many of whom are open and very proudly racist especially against Indians.

This and its related website have documented over and over the ongoing genocide against Indigenous Peoples following the two-phase process of genocide as laid out by Raphael Lemkin, a Polish jurist who coined the term genocide:

1) Destruction of the ‘national pattern’ of the targeted group: “Indian Wars”; smallpox-infected blankets; fostering and exacerbating inter-tribal and inter-nation rivalries; Indian Residential Schools (both Frank and Helen suffered horrible abuses in the worst of the Canadian Indian Residential Schools)  http://jimcraven10.wordpress.com/?s=tribunal+findings

2) Imposition of the ‘national pattern’ on the remnants of the targeted group: Indian Residential Schools; Corrupt Tribal Councils; Casinos; Chump-change grants that never reach the average Indian; Corruption; Kangaroo Courts run by racist judges and prosecutors coupled with police who do not mind perjury or whatever for cover-up or what they regard as “The Cause”.

I have personally witnessed Frank and Helen doing not only lawful activism, but in fact it was they who were upholding the law while some rich and protected child abusers, seeking and using Native children, remained protected even when photos and street intelligence had been passed on to the Canadian government (with names, dates, places and alleged offenses) to try to stop the harm going on. In all the years I have known them, I have known them to be selfless and totally dedicated to investigating, documenting, exposing and demanding legal accountability for the ongoing genocide in Canada that even high-levels of the U.N. appear to now recognize. Since the 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide was ratified by Canada in 1953 (and only by the U.S. in 1988 and then with a “Sovereignty Amendment” that invalidates the ratification as well as Article 6 Section 2 of the U.S. Constitution itself) and thus is part of the “Supreme Law of Canada”, Frank and Helen have always acted to uphold, and expose the violations of, Canadian Law and not only against Indigenous persons but those violations against any innocents being unfairly attacked and in violation not only of Law, but of standard police protocols as well [more incentive for cover-ups and intimidation of those who refuse].

This pattern of harassment, false arrest, and all the standard pretexts used is familiar to Indigenous People all over Canada and the U.S. And even across borders and provincial/state lines, the thug elements in law enforcement and the courts, do not appear to have a lot of originality as the modus operandi for their unlawful actions and then later cover-ups are all standard and not that hard to knock down when probed in courts where the possibility of justice and honest inquiry without fear or favor exists.

They are master wood carvers who have had their tools and ability to work taken from them. Why are they being targeted? Because from the point of view of those who originated, built and still run this racist and genocidal system that is also a desecration of all that is good in Canada and in being a Canadian, the most “dangerous” kind of Indian, or indeed any oppressed person, is one who refuses to aid and abet their own extinction and that of their People; one who refuses to be a victim in silence; one who refuses to sell-out and become a wasicu or “fat taker”; one who refuses to participate in, tolerate or keep quiet about any forms of corruption and oppression. That is what I have personally witnessed them doing along with doing “street surveillance and intelligence” (nothing more “invisible” than what appears to be a “drunken Indian” on the street) that helped to expose and deter serious crimes about which law enforcement was well aware and did nothing. I know this not only from Frank and Helen, I know this from personal observation and experience.

we are still under attack from these rcmp in fraser valley.we were pulled over by rcmp mcbride on hiway 1 after we left home and he used the checking your drivers and car insurance as excuse again this is always used. after he checked he let us go but followed us closely to close for comfort so we called dorthy odonell our lawyer. this officer was using same tactics as this rcmp who beat helen up in this photo so we know the commanding officer who also beat helen up is behind these rookies pulling us over and using threats and abusing us like we broke some law.we are not breaking any laws.this rcmp emond is now commander of rcmp in fraser valley and he demanded helen show up at rcmp station for finger prints even though the rcmp who beat her up charged her but the crown proscutor in chilliwack deny his case from lack of evidence.we called wittness to go with us to crown councils office in chilliwack and had them stamp the charge sheet from the rcmp who beat her up and asked them to phone rcmp emond to tell him we were at crowns office and  asked emond if helen was wanted and he said no.but they are still chasing us around and fact that rcmp emond and this rcmp in photo beat helen up in fraser valley is abuse and violates our rights.we are worried we will get shot dead or worse one of rcmp may get hurt too we dont know what to do about them.
because this last beating  they broke her fingers and injured her back and arms and her bum.the trauma that the whole family is put through by this conduct isnt good…these rcmp were also involved in the social services eviction so we cant get proper health care for our disabilitys so its not a good thing that rcmp should get paid to abuse us we are elders from weseweten and heiltsuk nation here in b.c.   because of this we are becomming homeless and may have to live in van on streets.this is an act of genocide by rcmp and bc. government agency…most of all abuse by rcmp…the criminal charges of assault causing bodily harm for  all injurys should be laid against these rcmp and racist hate crimes.helen is from hiway of tears and she has a paper trail of documents relating to same treatment from rcmp in burns lake area,we wer forced out of that area by this tactic and they stole many vans and cars using same tactics here.in lower main land its going o again and we are not going to run we are going to stand our ground and do what ever it takes to find justice. how do we defend our selves against this terror we are puttng up with.we need attention on this and help to stop this abuse of power..-frank martin,,telqua/helen michell,,sara martin

this is what we are still facing every day from rcmp.were ever we go they follow and keep the threat over our heads like they are intimidating us so they can do this over and over.pull us over beat the driver up and yell at passengers.we are not breaking any laws and need to get this out, support our request to see this international person comming to vancouver so we may give our evidence.thank you

Important: For James Anaya.  As I am an indigenous elder, and a human rights defender, and also a severely disabled women, indigenous to British Columbia, Canada.  I would very much like to attend this very important meeting, in Vancouver B.C. with regards to the racial profiling of us, as indigenous people, by the Royal Canadian Mounted Police of Chilliwack B.C.  I would like to attend this important meeting along with my husband, Frank Martin and my daughter Sweetgrass Martin. My indigenous name is Telquaa, and my english name is Helen Michell.

As on May 30, 2013, we were stopped by the Chilliwack RCMP, for no reason what so ever. I believe it was ‘racial profiling’ of us as indigenous peoples. I have marked in my calender, of the  many times we have been stopped, harrassed and intimidated by the RCMP, of Chilliwack and Agassiz detatchments. This has not stopped to this day. But, on this day of May 30, 2013, we were pulled over on the reservation, by the chilliwack RCMP officer. As I was driving, I pulled over for him. He asked me for my drivers license and registration papers. While I was pulling these papers out, this officer, started an arguement with my passenger and husband, over nothing. He was a very scary police officer. I had found my car papers and was handing them too him, when he suddenly grabbed my left hand, and banged it onto my window, and his actions sent my car papers flying onto the ground. For no reason what so ever, he slapped his hand cuffs onto my hurt hand. He opened the car door, and started to drag me out of the car, with the handcuffs. I started screaming and yelling, that he was hurting me. But he was not listening. My seat belt was still on, and so he had to let go for a minute, and reached over to undo my seat belt. When he finally got the seat belt off, he jerked, and dragged me out of the van, and threw me onto the ground, where I layed, as I am a parpalegic, and cannot help to get myself up off the ground. He was jumping around me, and yelling his head off, for me to get up. He was saying ugly things like “get up you f***** bitch”, ‘get up’, ‘you are under arrest’. I was not told, until later on, what I was under arrest for. AS I was hurt so bad, I had to wait for an ambulance, to take me to the hospital. But even than, there was about ten policemen, in the hospital with me, waiting to take me to the jail.  Later on, I was told by a province newspaper reporter, who interviewed this police officer that assaulted me, that I was under arrest for punching this police officer, twice. This never happened. I was the one that was so badly assaulted by this police officer. I was dragged off the emergency bed, by these same officers, and they told
the doctors that I was under arrest, and that they were taking me to jail. They had to take me back into the hospital, as they could not put me into the police car.  Inside the hospital, I was charged to assaulting the police officer, and told to go to the Chilliwack police station on Sept. 10, 2013 at 10 am for fingerprinting and to show up in Chilliwack court on Sept. 17, 2013, to set a trial date. But, before all these dates came up, the Chilliwack police station called me at home, to tell me that the Chilliwack justice system, crown council would not go ahead with the case, as there was not enough evidence.  But I was so badly beaten up, and my daughter, who had a good camera, took many pictures, from the begining to end.   If at all possible, I would like to attend this very important meeting, on Oct. 10, 2013, in Vancouver B.C. Canada. If only to meet, you, James Anaya, personnally. We as indigenous peoples of British Columbia, Canada, we never get the chance to go to these important meetings, as it is always the higher ups, chiefs and councils, that get to go and speak at these meetings. I think it is very important that we get to attend this important meeting, and that our words and feelings get heard. Our indigenous rights, human rights, elder rights, as human rights defenders, has been grossly violated, by the authorities of this province, as we would like very much to be heard. Please do not leave us out. Please let us know when and where this meeting will take place. WE will be there.  This beating and assault took place on the very day, that the reconcilliation events began in CAnada. There are to many indigenous peoples human rights violations going on, with us especially, that we need to do something about it. That is why this meeting is so important for us to attend.  Please do not disregard us. Hopeing to see you than.

Canada: New developments and challenges facing indigenous peoples to be examined by UN rights expert

logo-acnudhGENEVA (3 October 2013) – United Nations Special Rapporteur on the rights of indigenous peoples, James Anaya, will visit Canada from 7 to 15 October 2013 to examine the situation of indigenous peoples in the country. This visit follows up a mission to Canada by the previous Special Rapporteur in 2004. “I will be looking at the issues faced by First Nations, Inuit and Métis people in Canada”, the human rights expert said,“including in relation to matters of reconciliation, governance and self-government; lands and resources; and health, education and economic development.” Announcing his first visit to Canada as UN Special Rapporteur, Mr. Anaya emphasized that the mission “aims at assessing the human rights concern of indigenous peoples in light of international standards to which Canada has committed, and at identifying good practices in Canadian law and policy as well as needed reforms.

The Special Rapporteur, who visits the country at the invitation of the Government and indigenous peoples, will travel to remote communities and urban areas in the provinces of Ontario, Quebec, British Columbia, Alberta, Saskatchewan, and Manitoba. In these areas, he will hold discussions and consultations with indigenous peoples and their representatives and meet with federal and provincial government officials.

At the end of the seven-day mission, on 15 October 2013, Mr. Anaya will hold a press conference, from 2 to 3 pm at the National Press Theatre, located on the first floor of the National Press Building, in Ottawa, Ontario.Following the visit, the Special Rapporteur will prepare and make public a report on the visit’s findings, which will be presented to the UN Human Rights Council in September 2014.

CANADA. Avances y nuevos desafíos que enfrentan los pueblos indígenas serán examinados en visita del Relator Especial

acnudhGINEBRA (3 octubre 2013) – Relator Especial de las Naciones Unidas sobre los derechos de los pueblos indígenas, James Anaya, visitará Canadá del 7 a 15 octubre 2013 para examinar la situación de los pueblos indígenas en el país. Esta visita se produce tras una misión a Canadá por el anterior Relator Especial en 2004. “Voy a estar investigando en los problemas que enfrentan las Primeras Naciones, los Inuit y los Métis del Canadá“, dijo el experto en derechos humanos,“incluyendo asuntos en relación con la reconciliación, la gobernanza y el autogobierno, tierras y recursos; la salud, la educación y el desarrollo económico “. Al anunciar su primera visita a Canadá como Relator Especial de la ONU, el Sr. Anaya hizo hincapié en que la misión “tiene como objetivo la evaluación de los derechos humanos de los pueblos indígenas, a la luz de las normas internacionales de los que Canadá ha suscrito, y en la identificación de buenas prácticas en el derecho y la política canadiense, así como las reformas necesarias. “

El Relator Especial, que visita el país por invitación del Gobierno y los pueblos indígenas, viajará a comunidades remotas y a zonas urbanas de las provincias de Ontario, Quebec, Columbia Británica, Alberta, Saskatchewan y Manitoba. En estas áreas, se llevarán a cabo debates y consultas con los pueblos indígenas y sus representantes, y se reunirá con funcionarios del gobierno federal y provincial.

Al final de la misión de siete días, el 15 de octubre de 2013, el Sr. Anaya ofrecerá una conferencia de prensa, 2-3 PM, en el National Press Theatre, ubicado en el primer piso del Edificio Nacional de la Prensa, en Ottawa, Ontario . Después de la visita, el Relator Especial preparará y hará público un informe sobre las conclusiones de la visita, que será presentado al Consejo de Derechos Humanos de la ONU en septiembre de 2014.
